For example, and I expect a few of you know what I am referring to… if you photograph a “goshawk” in the middle of Tucson, and the area’s leading birders and everyone else tells you it’s a Cooper’s Hawk …you should listen to them. Don’t even bring up using tapes on endangered species.

The American Bird Conservancy (ABC) and Black Swamp Bird Observatory (BSBO) recently filed a lawsuit against the federal government arguing that a planned wind turbine near the famed birding hotspot of Ottawa National Wildlife Refuge is illegal. A handful of endangered species have been observed at the refuge (or in the vicinity) as well.

One might assume that construction of a border wall through a sensitive national wildlife refuge would be prevented, or at least slowed, by a thicket of lawsuits under statutes such as the National Environmental Policy Act (NEPA) and the Endangered Species Act (ESA).
