The term “take” is defined as killing a listed species but also includes “harm,” which is defined in regulation as including “significant habitat modification or degradation where it actually kills or injures wildlife by significantly impairing essential behavioral patterns, including breeding, feeding, or sheltering 2.
However, the Migratory Bird Treaty Act (“MBTA”) broadly prohibits the “take” of any bird, which effectively means that a protected bird cannot be killed, harassed, or otherwise adversely impacted. They argued that the scientific research exception only applied to research on the animal to be taken.
Because I have birded southern California in winter several times there weren’t any of the normally occurring birds that I could get within easy reach of my in-laws house in Orange County. Permission to use the car was obtained from the brother-in-law and permission to be missing until 10 AM was obtained from Daisy.
However, Jewish and Islamic groups which can prove animals do not suffer more during ritual killing than in an ordinary slaughterhouse will be able to apply for permits.
So, remember the incident in which an orca whale attacked and killed its trainer at Sea World? I sincerely hope this leads to a change in law regarding animals in captivity. Now there's going to be a Congressional hearing this week about it. At a minimum, they should stop the captivity of orca whales.
More than 60,000 cats were killed in Illinois animal pounds and shelters in 2006. That’s 5,000 cats killed every month, and 160 each day. Illinois is one of the few states with laws already requiring pounds and shelters to report the fate of animals in their custody. Things don't look too good.
Or, it’s just “bad luck”, that the laws of probability just have not worked in your favor. However, if there’s a good thing about the laws of probability and birding, it’s that the longer you don’t see a bird when you “should”, the more likely you will see that bird with every try.
California recently passed a law protecting animal researchers from animal activists. This law changes NOTHING. Ralph Freeman has killed cats and kittens in his laboratory at UC Berkeley with no benefit for humans for over twenty years. In the short term at least, it's not working. I recall one day when his sister-in-law was speaking with him about what she was feeding her children, and it wasn't a vegan-centered conversation. Sister-in-law doesn't disagree with what TD says about hot dogs, but says: "Everything in moderation." Sometimes permanently. I think it was about hot dogs. Or child molestation. ".
The law of unintended consequences has tragic effects at a zoo in England, as rat poison ends up killing the Rainbow Lorikeets it was intended to protect. So crazy it just might work? Scientists ponder the feasibility of genetically engineering chickens to lay the eggs of endangered bird species.
HSUS’ latest public relations gimmick is part of a larger attempt by the very animal control officers responsible for this neglect and abuse to reform their image from one of “dog catcher” to “humane law enforcement.” Nathan Winograd is an advocate for no-kill shelters (and is the author of several books on the subject).
Meanwhile, I would love to be able to have some kind of law against human beings producing/reproducing more than one person per person. And when the option is rounding them up and killing them, TNR looks like an especially attractive option. And this is one of them. But who cares about me? What do you all t hink?
The beauty of this area is breathtaking, though the burned trunks are reminders that it is still recovering from the disastrous Station Fire of 2009, which scorched over 250 square miles and killed two firefighters.
